Terms of Service

You must be at least 13 years old to create an account, or older if your jurisdiction requires it. You are responsible for the accuracy of your account information, for keeping your credentials confidential, and for all activity that occurs under your account.

Image to Prompt provides AI-driven prompt generation tools, including image-to-prompt, text-to-prompt, video prompt generation, batch processing, and downstream image and video generation. Some features are subject to credit consumption and to the availability of upstream model providers.

You agree not to:

Upload images or text that infringe third-party intellectual property, privacy, or publicity rights.

Generate or distribute content that is illegal, harassing, defamatory, sexually explicit involving minors, deceptive, or designed to deceive (deepfakes, identity impersonation, election interference).

Reverse engineer, scrape, or attempt to access non-public APIs.

Use the Service to build a competing service, or to train competing AI models without prior written consent.

Circumvent rate limits, credit caps, or any technical or contractual restriction.

We may suspend or terminate accounts that violate this section.

You retain ownership of the reference images, text prompts, and outputs you create with the Service. You grant us a limited, worldwide, royalty-free license to host, process, and display this content solely to operate the Service for you, to improve product quality through aggregated and de-identified analysis, and to comply with legal obligations.

You are solely responsible for ensuring that you have the rights to upload and process every reference image you submit.

Subject to your compliance with these Terms, you own the prompts, images, and videos generated for you by the Service. Output may not be unique — others may submit similar inputs and receive similar outputs. We make no claim of ownership over your generated output.

Paid plans renew automatically until cancelled. Credits granted by a plan reset on each billing cycle and do not roll over unless explicitly stated. One-time credit packs do not expire while your account is active.

All prices are exclusive of taxes unless stated otherwise. We may change prices with 30 days' notice.

Refunds are governed by the [Refund Policy](/refund-policy), which is incorporated into these Terms by reference.

The Service relies on third-party model providers, payment processors, and infrastructure vendors. We are not responsible for outages, errors, or content moderation decisions made by these third parties.

The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that generated outputs will be accurate, lawful, or fit for any particular purpose.

To the maximum extent permitted by law, our total liability for any claim arising out of or related to the Service is limited to the amounts you paid to us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost data, or business interruption.

You agree to indemnify and hold harmless Image to Prompt and its affiliates from any third-party claim arising from (a) your use of the Service in violation of these Terms, (b) content you upload or generate, or (c) your violation of any law or third-party right.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if continued service creates a legal or security risk, or if we discontinue the Service. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, governing law) will survive.

These Terms are governed by the laws of the jurisdiction where the operating entity is registered, without regard to conflict-of-laws principles. Disputes will be resolved in the competent courts of that jurisdiction unless mandatory consumer protection laws require otherwise.

We may update these Terms from time to time. Material changes will be communicated by an in-product notice or by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
